1) Who we are

2) Eligibility (13+)

4) Events, guests, and guest identity modes
Moments lets hosts create event galleries and share a link or code with guests. Hosts can configure guest identity requirements (for example, requiring sign-in or a guest name) and may set an event password.
You are responsible for how you share event links/codes and for inviting only people you intend to access an event.
5) User content (UGC) uploads and licenses
The Service may allow you (or your guests) to upload photos, videos, captions, names, and other content (“User Content”).
- Your rights: You retain any ownership you have in your User Content.
- License to operate the Service: You grant Moments a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, and display your User Content solely to provide, maintain, and improve the Service, including making your content available to the event participants you authorize.
- Host/guest access: Hosts and authorized guests may be able to view and download User Content within an event gallery.
6) Acceptable use
You agree not to use the Service to:
- Upload illegal content or content that infringes others’ rights.
- Upload content depicting sexual exploitation of minors or otherwise abusive content.
- Harass, threaten, or dox others.
- Attempt to bypass access controls, rate limits, or security.
- Distribute malware or interfere with the Service.
- Use the Service to develop or train models on others’ content without permission.
We may remove content or suspend accounts that violate these Terms or that create risk for the Service or others.
7) Copyright and takedowns (DMCA)
If you believe content on the Service infringes your copyright, you may contact us at [Copyright Email] with a detailed notice. We may remove content and terminate repeat infringers where appropriate.
8) Paid plans, checkout, and invoices
Certain plans or add-ons may require payment (for example, higher storage limits). Payments and invoice generation may be processed via third-party providers (for example, Polar).
- Checkout provider: You authorize our checkout provider and payment processors to charge your selected payment method.
- Taxes: Prices may exclude taxes unless stated otherwise. You are responsible for any applicable taxes.
- Renewals: If you purchase a subscription, it may renew automatically until you cancel, as disclosed at purchase.
- Refunds: Refund eligibility (if any) will be described at checkout or in an applicable refund policy. If you are an EU/EEA/UK consumer, you may have mandatory rights that cannot be waived.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.
12) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOMENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO MOMENTS FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY (OR $100 IF YOU HAVE NOT PAID ANY AMOUNTS), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW (INCLUDING CERTAIN EU CONSUMER PROTECTIONS).
13) Indemnity
You agree to indemnify and hold harmless Moments from claims arising out of your use of the Service or your User Content, including claims that your content infringes third-party rights or violates law.
This indemnity does not apply where prohibited by applicable consumer protection laws.
14) Governing law and disputes
These Terms are governed by the laws of [Governing Law State/Country], excluding its conflict of laws rules.
EU/EEA/UK consumer rights: If you are a consumer in the EU/EEA/UK, you may have the right to bring claims in your country of residence and mandatory consumer protection laws may apply.
